Gun Laws In Texas

There are no laws in Texas that prevent anyone of any age from possessing a firearm. There are also no statutes specifically prohibiting the carrying of a firearm, other than handguns. For years, it was illegal in Texas to open carry a handgun. But since January 2016, gun owners who have a license to carry (LTC) are legally able to open carry a handgun, as long as they do not do so recklessly or in the wrong location.

You may not carry a handgun at:

  • Airports
  • Churches
  • Schools
  • Racetracks
  • Hospitals
  • Amusement parks
  • Liquor stores/bars
  • Some restaurants
  • Courthouses
  • Certain businesses with stated rules against firearms

Not everyone can obtain an LTC – you must meet certain criteria first.


You might be ineligible for an LTC if you:


  • Cannot legally purchase a handgun
  • Have pending criminal charges
  • Have been convicted of a felony or a Class A or B misdemeanor
  • Have a chemical or alcohol dependency
  • Have defaulted on student loans, taxes, child support or other governmental fees
  • Have a protective or restraining order against you
  • Are diagnosed with a certain psychological disease

Unlawfully Carrying A Weapon In Texas

The new open carry legislation does not mean that all gun owners are protected from the charge of unlawfully carrying a weapon (UCW). Offenders can still face criminal charges for illegally carrying a handgun or another illegal weapon.

Illegal weapons that will result in a UCW charge include:


  • Explosive weapons
  • Switchblades
  • Brass knuckles
  • Nunchucks
  • Zip guns
  • Rifles with barrels less than 16 inches long
  • Fully automatic firearms
  • Short barrel shotguns with barrels less than 18 inches long
  • A firearm silencer
